The legal website Claims.co.uk has given an interesting review of how transfers are allowed to work.

The article emphasizes that clubs must talk to clubs, not to players or agents with the latter only being involved once the clubs have agreed a deal.  However, clubs can contact the agent of the player, who may then take the matter to the club that the player is currently with (with of course the option of “sell him or up his salary”.  But the agent specifically must not approach a player to persuade him to leave his current club.

As we will remember Ashley Cole and his agents illicitly met Chelsea who were then deducted three points, along with various other penalties.

However as The 3AM Verdict recently pointed out, the reports that we all see, seem to suggest personal terms come first in the rumours, but this seems incredibly unlikely, as it suggests a set of close yet highly secret meetings between club and player or agent, before the selling club are contacted.   More likely this is just media fantasy.
